The saddest case I ever handled… part 2.

We had the tape. Shelby County didn’t know we had the tape.

For weeks they told us Duanna was lying. For weeks we quietly asked them to settle. They refused.

So we gave the tape to the news.

By the next morning, the world had seen what happened to Duanna Johnson on that bench at 201 Poplar. The charges against her got dismissed. Bridges McRae pled guilty in federal court. We won our civil case against Shelby County.

The part I still can’t get past, the part that has stayed with me for eighteen years now, is that Duanna was murdered before we ever got to hand her the verdict.

Shot and killed on North Hollywood Street. That case is still unsolved.

You can win a courtroom and lose the person the courtroom was supposed to protect.

That’s the sentence that made me a different lawyer.

The saddest case I ever handled - Part 1 of 2

Some cases live in the news for a week and then disappear.

Some live in you for the rest of your career.

Duanna Johnson was one of the second kind. A Black, transgender woman in Memphis at the wrong moment in this city’s history. Picked up on a charge that would eventually be dropped. Taken to 201 Poplar to be booked.

What happened to her on that bench is the reason my law partner and I took the case.

Some cases you handle. Some cases stay with you. This one still does.

If you’re ever pulled over on suspicion of a DUI, the officer already knows more than you think…

They know your car. They know your speed. They know the direction you came from.

And in Tennessee, the body cam knows the rest.

The one thing they don’t know yet is what you’re about to say. Most people volunteer the entire case against themselves in the first ninety seconds of the stop.

After twenty years of watching this play out, the difference between a plea and a conviction is usually the sentences you didn’t need to say.

The case that made me. Part 4 of 4… the verdict.

Reckless homicide.

Going into that trial, I would have called second-degree murder a win. Not guilty was a fantasy. Reckless homicide, with the shot pattern we had, was a verdict nobody in this city saw coming. Not the prosecution. Not the media. Not the shows that came calling after. Snapped. Fatal Attraction. All of them.

Most lawyers in Memphis wouldn’t touch this case. A Memphis police officer was the victim. Careers get made and buried on cases like that.

I took it anyway. And it became the case that told this city who I was.

The case that made me. Part 3… the hardest sell of my career.

Four shots in the back. One in the head. One in the chest.

That is not a shot pattern that argues itself as self-defense. Any prosecutor in this country will tell you the same. Any defense attorney in this country will tell you the same.

But the truth was Monique had been living in fear for years. And by the time she picked up that weapon, she was fully convinced that if she didn’t, Tony Hayes was going to kill her that night.

Convincing twelve strangers of the fear a woman lived with behind closed doors… that’s the job.

Different judges.
Different prosecutors.
