On Tuesday, Aztec Labor clients Jeff Reid and Travis Jenkins from Louisiana joined Aztec Labor Strategist Matt Bare in meeting with Senator Cassidy to discuss the critical importance of the H-2B program for small businesses across Louisiana and the nation. Representing Integrity, TigerGreen, Willowgrove, and Earthworks Pro, they emphasized the need for Certified Seasonal Employer language to help long-time H-2B users secure the workforce they depend on.

This designation would exempt qualified employers from the current visa cap and lottery system, allowing small businesses to reliably fill entry-level seasonal positions where U.S. workers are unavailable. In turn, these businesses can continue growing, creating more higher-level jobs for American workers, and strengthening local economies. The H-2B program remains a vital tool for seasonal employers — now it’s up to Congress to support them.

Action Needed: Contact your Members of Congress and urge them to support inclusion of Rep. Andy Harris’ Certified Seasonal Employer (CSE) Designation in the FY27 DHS Appropriations baseline bill.

The next 6 weeks are critical. Including CSE language in the baseline bill is the best path to protecting it through the legislative process. President Trump and the White House support this provision.

The CSE Designation rewards long-time, compliant H-2B employers by permanently exempting their highest certified worker count from the cap.

USCIS announced today that the April 1 Returning Worker cap has officially been reached.

While most of our Group F clients made it through, we know a few did not receive the outcome they were hoping for. That said, planning ahead matters—those who submitted backup May 1 applications are already in motion.

The Department of Labor has begun processing May 1 filings, with timelines only about 3–4 weeks behind the April 1 petition submissions. That means earliest worker arrivals are still expected around mid-June.

Not the result everyone wanted—but a strong reminder that having a backup plan keeps your workforce plans on track.

There may be significant progress on a long-term solution to the H-2B cap.

Industry groups and advocates are working toward language that would create a Certified Seasonal Employer designation, potentially exempting employers who have participated in the H-2B program for 5+ years from the annual cap. While final language is still being finalized, this proposal could represent a major step forward for seasonal employers who depend on the program.

Momentum is building thanks to strong bipartisan and bicameral support, and Congressman Harris has been instrumental in helping move this effort forward.

Big news for seasonal employers and workers! The Trump administration has shifted course on H-2B visa allocations for Fiscal Year 2026 — moving from earlier signals of a limited supplemental release to making the full supplemental amount available that many businesses have been advocating for.

🔹 Initially, the Departments of Homeland Security (DHS) and Labor (DOL) announced they would release only 35,000 additional H-2B visas on top of the base annual cap of 66,000 — a sharp reduction compared to recent years.

🔹 This cut (nearly 50% below past supplemental levels) prompted widespread response from industry groups urging officials to use the full discretionary authority to release 64,716 H-2B visas for FY 2026 — the maximum supplemental amount under congressional authority.

✅ Result: The administration has reversed course and will now release the full 64,716 supplemental H-2B visas — a major win for employers and workers in seasonal, hospitality, tourism, seafood processing, and other labor-intensive industries.

This development brings greater certainty to workforce planning and helps fill critical seasonal labor gaps across the nation.

The distribution is as follows:

FY 2026 First Returning Worker Allocation

Visas Available: 18,490

Dates of Need (Work Start Dates): January 1, 2026 – March 31, 2026

Petition Filing Start Date: January 30, 2026

FY 2026 Second Returning Worker Allocation

Visas Available: 27,736, plus any unused visas from the FY 2026 First Returning Worker Allocation

Dates of Need (Work Start Dates): April 1, 2026 – April 30, 2026

Petition Filing Start Date: Employers may file no earlier than 15 days after the second-half statutory cap is reached

FY 2026 Third Allocation

Visas Available: 18,490, plus any unused visas from the FY 2026 First and Second Allocations

Dates of Need (Work Start Dates): May 1, 2026 – September 30, 2026

Petition Filing Start Date: Employers may file no earlier than 45 days after the second-half statutory cap is reached

The Aztec Labor team met with seasonal employers today to provide the latest news about H-2B visa developments. Highlights include:

On January 5th, 2026, the U.S. Department of Labor published the "lottery" results for April 1 H2B visa applications. Results are available at https://www.dol.gov/agencies/eta/foreign-labor

On December 31st, 2025, the government announced that they would release 35,000 "supplemental" H-2B visas, which are typically allocated to returning workers and workers from Central America. However, the date of release and the exact allocations are not yet known.

Employers are likely going to face delays in receiving workers, due to new consulate requirements for in-person interviews

Depending on the employer's filing strategy and staffing needs, they may choose between their lottery assignment, supplemental visas, in-country worker transfers, or other strategies to meet their staffing needs
