"The Environmental Protection Agency and U.S. Army Corps of Engineers (the agencies) are in receipt of the U.S. District Court for the District of Arizona’s August 30, 2021, an order vacating and remanding the Navigable Waters Protection Rule in the case of Pascua Yaqui Tribe v. U.S. Environmental Protection Agency.

In light of this order, the agencies have halted implementation of the Navigable Waters Protection Rule and are interpreting 'waters of the United States' consistent with the pre-2015 regulatory regime until further notice."

On April 15, 2020, a federal court in the District of Montana issued a ruling that determined the USACE’ 2017 re-issuance of Nationwide Permit 12 - Utility Line Activities (NWP-12) was arbitrary and capricious and violated the Endangered Species Act (“ESA”).

On May 11, 2020, following misperception and speculation about the April 15th ruling and future status of NWP-12, the judge from the District Court narrowed the scope of the ruling to only “new” oil and gas pipeline construction. The result of the new order allows non-pipeline construction activities (i.e., electric, water, sewer, broadband, and other utility activities that build and maintain linear infrastructure) and routine maintenance, inspection, and repair activities on existing oil and gas pipelines under NWP-12.

As stated in the May 11, 2020 order:
“NWP 12 is vacated as it relates to the construction of new oil and gas pipelines pending completion of the consultation process and compliance with all environmental statutes and regulations. NWP 12 remains in place during remand insofar as it authorizes non-pipeline construction activities and routine maintenance, inspection, and repair activities on existing NWP 12 projects.”

“The Corps is enjoined from authoring any dredge or fill activities for the construction of new oil and gas pipelines under NWP 12 pending completion of the consultation process and compliance with all environmental statutes and regulations. The Corps remains able to authorize dredge or fill activities for non-pipeline construction activities and routine maintenance, inspection, and repair activities on existing NWP 12 projects.”

The Environmental Protection Agency (EPA) and the Department of the Army’s Navigable Waters Protection Rule: Definition of “Waters of the United States” was published in the Federal Register.

The final rule will become effective on June 22, 2020.

The event is sponsored by the Brazos Valley Solid Waste Management Agency (BVSWMA) and is an opportunity to dispose of household hazardous waste and divert these materials from the Twin Oaks Landfill.
