August 5, 2026 there was a major federal court ruling involving suppressors.

On August 5, U.S. District Judge James Wesley Hendrix in the Northern District of Texas ruled in Silencer Shop Foundation v. ATF, consolidated with Jensen v. ATF, that major portions of the NFA registration and approval system are unconstitutional when applied to the NFA items whose federal making and transfer tax was reduced to $0. That includes suppressors, SBRs, and SBSs.

Even more importantly, today, August 13, the ruling is actually in effect. The judge initially stayed his judgment for seven days so DOJ could seek appellate relief. That stay has now expired without the government obtaining an extension.

For a covered suppressor transaction in Texas, this can mean:

No Form 4
No fingerprints/photo submitted to ATF
No NFA registration
No waiting for ATF approval
Customer completes the normal Form 4473/background check
Customer can take the suppressor home after the ordinary firearm transfer requirements are satisfied.
