Section 14 of Republic Act No. 9275, otherwise known as “Philippine Clean Water Act of 2004”, states that “The discharge permit shall be the legal authorization granted by the Department to discharge wastewater: Provided, that the discharge permit shall specify among others, the quantity and quality of effluent that said facilities are allowed to discharge into a particular water body, compliance schedule and monitoring equipment”.

The Discharge Permit shall not be issued to establishments if their waste-water effluent do not pass the standard set by law.

What is ECC (Environmental Compliance Permit) and CNC (Certificate of Non-Coverage)? Why is it required by the government? Any establishment or project that can cause negative impact or risk in the environment such as:
- GASOLINE STATION
- DENTAL CLINICS
- HOSPITALS
- HOTELS AND RESORTS
- SANITARY LANDFILL
- PIGGERY AND POULTRY
- TELCOS AND CELL SITES
- POWER GENERATION
- MINING PROJECTS
- FLORA AND FAUNA
- AGRICULTURAL
- CONSTRUCTION
is required to secure an Environmental Compliance Certificate (ECC) from the DENR- EMB (Environmental Management Bureau).
An ECC is issued by the Department of Environment and Natural Resources - Environmental Management Board after a positive review of the project application. This Certificate indicated that the proposed project or undertaking will not cause a significantly negative impact on the Philippine Environment.
The ECC contains specific measures and conditions that must be met by the project proponents before and during the operation of the project. In some cases, conditions are listed to be performed during the abandonment phase to lessen identified potential environmental impacts.
An ECC also certified that the proponent has complied with all the requirements of the Environmental Impact Statement (EIS) System and has committed to implement its approved Environmental Management Plan.
What is CNC?
CNC or Certificate of Non-Coverage is a certification issued by the EMB certifying that based on the submitted Project Description, The Project is not covered by the EIS System and is not required to secure ECC.
If your projects are exempted from securing an Environmental Compliance Certificate, you may now opt to apply for and obtain a CNC.
