If your business discharges any liquid waste from a commercial or industrial process — from a commercial kitchen, a vehicle wash, a food production line, or a manufacturing facility — into the public sewer, you are legally required to hold a Trade Effluent Consent from your water company.

In 2026, enforcement bodies are actively increasing oversight. Inspections are up. Data-led monitoring identifies breaches that previously went undetected. And the penalties for operating without a valid consent, or breaching its conditions, include prosecution and significant fines.

The EA has expanded its water enforcement team almost fivefold since 2023, with over 8,000 of the 10,000 planned inspections for 2025/26 completed by February — reflecting a broader shift in enforcement culture across the sector. Every commercial operator needs to get to grips with ensuring their site is compliant.
