🌊 Ever wondered about those strips of land between your cottage and the lake in Muskoka? πŸ€” Let's talk Shore Road Allowances! 🏞️

Did you know these historical strips were originally set aside by The Crown in the 1800s for public access and transportation? πŸ›Ά Back then, they were super important for logging and steamboat travel! 🚒🌲

Fast forward to 2001, and the Municipal Act shifted ownership of most of these allowances from the Crown to your local municipalities. 🏘️ This means your town now manages them! πŸ“œ

Here in Muskoka, we also have the Original Shore Road Allowance Closure Policy C-LS-08! πŸ“œ This policy guides how municipalities deal with requests to close and potentially sell these allowances to property owners. It's a key part of how we balance public access with private property rights. βš–οΈ

Why would you want to purchase a Shore Road Allowance? πŸ€” Here are a few reasons:

Increased Privacy: 🀫 Gain more control over your shoreline and enhance your privacy.
- Property Expansion: 🏑 Expand your usable property, allowing for more landscaping or recreational space.
- Protecting Your Dock/Shoreline: βš“οΈ Ensure your dock or shoreline improvements are fully within your property boundaries.
- Increased Property Value: πŸ’° Adding that land can increase your property's overall value.
- Certainty: πŸ“ removes any uncertainty regarding the ownership of the land abutting your shoreline.

But here’s the tricky part! ⚠️ Surveying these allowances in Muskoka can be challenging. Many of our lakes are historically regulated, meaning water levels are controlled by dams. πŸ’§ This often means we need to retrace the original water boundary, which is now typically located underwater! 🌊 Finding that historic line can be elusive and requires specialized expertise and careful research. πŸ•΅οΈβ€β™‚οΈ

In Muskoka, with all our beautiful lakes, these allowances are a hot topic! β˜€οΈ We're talking balancing private property rights with public access, protecting our environment, and navigating those endless bylaws. πŸ—οΈπŸŒΏ

Ever wondered how land surveyors figure out those tricky property lines? 🏑 It's more than just tape measures and GPS! πŸ“ We rely on something called the "hierarchy of evidence," and fences play a surprisingly important role. 🧐

In Ontario, this "hierarchy" is rooted in common law that dates back to the 1800’s, and it's a topic that deserves its own deep dive! But today, let's focus on how it relates to fences. πŸ˜‰

Here's the quick rundown of the hierarchy:
1. Natural Boundaries: 🏞️ (Think rivers, lakes, etc.)
2. Original Monuments: πŸ“ (Those markers placed during the original survey.)
3. Occupation (Possession): 🚧 (Like fences, when they can be tied back to the original survey.)
4. Measurements: πŸ“ πŸ“(Distances and bearings from plans and deeds.)

It often surprises clients who bring me their historical records when I say those numbers on their old deeds or surveys are the LEAST important piece of evidence! 🀯

So, where do fences fit in? πŸ€” When the original markers are gone, we have to determine if an old fence is evidence of occupation and if it reflects the original boundary. It’s a puzzle! 🧩

This often involves digging into old surveys, interviewing locals, and a LOT of historical research. πŸ•΅οΈβ€β™‚οΈ It's a challenge, but we love it!

Ultimately, it's all about thorough research and detailed notes. πŸ“

We're here to ensure your property lines are clear and accurate! πŸ‘

Ever wondered what the difference is between "title" and "boundary" when it comes to your property? πŸ€” While they both define your real estate, they're not the same, and resolving related issues often requires different professionals!

πŸ“œ Title: This refers to your LEGAL right to own the land. It's a paper right, described by a legal description registered on your property. Think of it as your ownership document. πŸ“„

Who handles it? Lawyers! They're experts in determining ownership and resolving title problems like liens, misdescriptions, or fraud. βš–οΈ- BUT it is typical that Land Surveyors are the ones to identify the title issues in the course of a survey and bring all the related material and information to the attention of the client and lawyers.

Example issues: Incorrect legal descriptions, disputed ownership, or unregistered liens.

πŸ“ Boundary: This refers to the PHYSICAL limits of your land on the ground. Where are your actual property corners? Are they marked by fences, walls, or trees? 🌳🚧

Who handles it? Land surveyors! They determine the location of your boundaries and identify potential issues like easement disputes or encroachments. πŸ“
Example issues: Disagreements over fence placement, encroachments, or unclear property lines.
Why Both Matter & How They Work Together:

Sometimes, issues involve BOTH title and boundary. For instance, an encroachment like a roof overhang over a property line requires a surveyor to identify the physical issue and a lawyer to resolve the legal implications. 🀝
A boundary survey is unique because it is the only document that can identify both title and boundary issues, making it an essential service in any real estate transaction. βœ…
Key Takeaway:

Lawyers handle the LEGAL ownership (title).
Surveyors determine the PHYSICAL limits (boundary).
Don't hesitate to reach out to a lawyer or surveyor if you have any questions about your property! πŸ“ž
