MOST PEOPLE ASK: WHAT IS COUNCIL CESSION AND DEVELOPER CESSION? 🏠📑
One of the most common questions I receive from property buyers is the difference between Council Cession and Developer Cession, and what paperwork is required for each.
🏛️ COUNCIL CESSION
This is where the local authority/council is the landholding authority and the property is transferred to the buyer through a council cession.
Common documents include:
• Offer Letter / Agreement of Sale
• Approved Site Plan
• Verification of Survey Certificate
• Dispensation Certificate
• Council Cession documents
🏗️ DEVELOPER CESSION
This is where a private property developer owns or controls the land and transfers the buyer’s rights through a developer cession.
Common documents include:
• Parent Title Deed
• Approved Site Plan
• Subdivision Permit
• Development Permit
• Survey Certificate
• Dispensation Certificate
• Certificate of Compliance / Full Compliance Certificate, where applicable
• Agreement of Sale
• Developer Cession documents
📌 CAN YOU EVENTUALLY GET A TITLE DEED?
YES. Having a property under Council Cession or Developer Cession does not necessarily mean you can never obtain a Title Deed. Where the development is properly approved, surveyed and goes through the required legal and administrative processes, the property can ultimately be converted/transferred into individual title.
However, title is not automatic simply because you hold a cession. The specific development must meet the relevant requirements, and the process should be handled through the appropriate authorities and a registered conveyancer.
⚠️ Always conduct proper due diligence before paying for any property. Verify the paperwork and make sure the development is legally approved.
Know what you are buying. Verify the paperwork. Protect your investment.
