The items supplied by KMS are suitable only for the purpose designed and intended and the Customer must ensure the items are handled, stored, installed, used, worn, or otherwise, dealt with in a norm
al and proper manner and where applicable, in a manner consistent with the instructions given by the manufacturer. A Customer has the right to return items within 10 business days of the purchase or delivery of the said items if those items have been found unsuitable for the particular purpose and are in a good/original condition. Special orders will not be accepted for returns as these items are specifically ordered according to the Customer’s specific requirement
Items which have been correctly supplied are not returnable for credit. No returns will be accepted without original proof of purchase. No returns are permitted if the items have been partially or entirely disassembled or physically altered, or permanently installed, affixed, attached joined or added to, blended or combined with, or embedded within other goods or fitted to other goods, unless defective. Components, equipment, or related items must be fitted/installed by a suitably qualified technician. Proof of compliance is the Customer’s responsibility before any claim under warranty is entertained. Proof of failure of an electrical or electronic item must be accompanied by a certificate from an independent testing facility or a printout from a diagnostic machine to substantiate the claim. Failure to provide this is an inference that the fitment/installation was done without the correct/necessary equipment and the claim is voided. For safety reasons, KMS is unable to take the return of electrical goods (unless these are defective) and no lubricant/s chemicals if the seal is broken. Items that have been fitted, damaged goods, gasket sets that have been opened, items not in their original and undamaged packaging, and all electrical and electronic items will not be accepted. The freight cost of items returned must be paid by the Customer. Any returns must be in a saleable condition unless the return relates to defective items. All returned items will be subject to a reasonable charge for re-packaging and re-stocking
KMS reserves the right to withhold a refund until the returned item has been examined and tested. The Customer must ensure that it complies with the manufacturer’s standards and specifications when using items purchased from KMS. Warranty claims can only be considered if the items supplied and used in the reconditioning, assembly, and/or service of an engine have been installed by a qualified technician and/or by an engine reconditioner and/or workshop recognized by the Retail Motor Industry Organization (RMI). A detailed report must be produced to initiate the claim process. Suppose the Consumer Protection Act of 2008 does not apply to the transaction. In that case, the Customer indemnifies KMS against any claims, liability, damages, losses, costs, and/or expenses (including legal expenses) brought against KMS or caused by such claim as a result of, relating to, or in connection with any items KMS has supplied to the Customer. If the items appear to be defective after 6 months from the date of purchase but within the manufacturer’s warranty period Kotwals may, at the Customer’s request, send the items to the manufacturer. The manufacturer will then decide whether the claim is valid by their warranty policy. Warranty claims, refunds, exchanges will not be considered if the Customer produced incorrectly, or has no information for any item purchased. The onus of correct information and application is on the Customer. All items sold by KMS are subject to the manufacturer’s guarantee against faults and/or defects and are not a guarantee from KMS. All items subject to manufacturers’ guarantee will be sent to the manufacturer for claim and report, and only upon the manufacturer’s confirmation will credit be passed or items replaced. No guarantee is given to the Customer as to the suitability of the items sold and for any particular purpose and the Customer must ensure before use or installation, that the items are suitable for the purpose for which they have been purchased. The Customer must ensure upon collection/delivery, that the items listed on the sale document, invoice, or delivery note, correspond with the description, price, and quantity of the items purchased by the Customer. Items that are defaced (installed, disassembled, tampered with, primed, or modified) and not in their original state as sold, including any damage to the packaging of the lack of the original packaging, will not be accepted as a return. No claim will be dealt with if the required claim form is not completed in full. Chassis and Engine numbers are required to confirm correct fitment. All claims will be dealt with within 14 days. This is in line with the CPA Tribunal’s findings on the returns of items for inspection. The alleged failed item will not be replaced immediately. A credit or a replacement will be granted pending the outcome of the inspection. All claims not approved will be accompanied by a technical report. TECHNICAL DATA AN DIMENSIONS: Descriptions, dimensions, and data are obtained from manufacturers of the specific item. Whilst every caution is exercised to ensure accuracy, they, and in turn, KMS, offer no guarantee of the absolute correctness thereof.
