Legal Basis
The process is governed by the Constitution of the Federal Republic of Nigeria, Section 188.
⚠️ Important: Governors are NOT recalled the same way lawmakers are.
There is NO direct voter recall (like with senators or House members).
âś… The ONLY Legal Way to Remove a Governor: Impeachment
A governor can only be removed through impeachment by the State House of Assembly.
đź§ Step-by-Step Impeachment Process
1. Written Allegation
At least â…“ of the members of the State House of Assembly sign a written allegation of gross misconduct.
It is submitted to the Speaker.
2. Service of Notice
The Speaker serves the governor the allegations within 7 days.
The governor has the right to respond.
3. Investigation Panel
The Assembly passes a motion (by â…” majority) to investigate.
The Chief Judge of the State appoints a 7-member panel of people with integrity (not politicians).
4. Panel Investigation
The panel investigates and submits a report within 3 months.
The governor has full right to defend himself.
5. Final Vote
If the panel confirms gross misconduct, the House votes.
A â…” majority of ALL members is required to remove the governor.
👉 Once passed, the governor is immediately removed.
❌ What Nigerians CANNOT Do (Legally)
❌ No referendum to recall a governor
❌ No INEC-led recall process
❌ No court-only removal without impeachment
❌ No popular vote recall like in some other countries
⚖️ What Counts as “Gross Misconduct”?
The Constitution keeps it broad, but courts have accepted things like:
Corruption or financial recklessness
Abuse of office
Constitutional violations
Serious breach of oath of office

Citizens can:
Organize mass civic pressure
Petition lawmakers continuously
Use media, civil society, and courts
Mobilize peaceful protests
Vote the governor out in the next election
These don’t remove a governor directly—but they can force impeachment politically.
